1. Agreement to Terms
By accessing or using SourceKeep ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and SourceKeep regarding your use of the Service.
2. Description of Service
SourceKeep provides a git hosting platform that allows users to store, manage, and collaborate on source code repositories. The Service includes:
- Git repository hosting
- Web-based repository browsing
- User authentication and access control
- SSH and HTTPS access to repositories
3. Account Registration
3.1 Account Requirements
To use certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Be responsible for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Age Requirements
You must be at least 13 years old to use SourceKeep. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
Parents or guardians who create accounts for minors are fully responsible for the minor's use of the Service and compliance with these Terms. By allowing a minor to use the Service, you represent that you are the minor's parent or legal guardian and accept these Terms on their behalf.
Children under 13 years old may not use SourceKeep, even with parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA).
4. Your Content
4.1 Ownership
You retain all ownership rights to the content you upload, submit, or display on the Service ("Your Content"). SourceKeep does not claim ownership of Your Content.
4.2 License to SourceKeep
By uploading Your Content, you grant SourceKeep a limited license to store, display, and transmit Your Content solely to provide the Service. This license is:
- Non-exclusive and royalty-free
- Limited to operating and improving the Service
- Terminated when you delete Your Content or your account
4.3 Public Repositories
If you make a repository public, you acknowledge that Your Content in that repository will be accessible to anyone on the internet. You are responsible for ensuring you have the right to make such content public.
4.4 Responsibility for Content
You are solely responsible for Your Content and represent that:
- You own or have the necessary rights to Your Content
- Your Content does not infringe any third-party rights
- Your Content complies with all applicable laws
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe intellectual property rights of others
- Upload malware, viruses, or malicious code intended to harm others
- Distribute spam, phishing content, or fraudulent material
- Harass, abuse, or harm other users
- Upload illegal content, including child exploitation material
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service's infrastructure
- Use the Service for cryptocurrency mining
- Resell or redistribute the Service without authorization
- Use automated means to access the Service except through our official APIs
We reserve the right to remove content and suspend accounts that violate these terms, with or without notice.
6. Intellectual Property
The Service, including its design, features, and documentation, is owned by SourceKeep and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the Service
- Reverse engineer or decompile the Service
- Remove any proprietary notices from the Service
- Use our trademarks without written permission
7. Third-Party Services
The Service may integrate with third-party services (e.g., GitHub, Google for authentication). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:
- Perform scheduled maintenance with reasonable notice
- Experience unplanned downtime due to technical issues
- Modify, suspend, or discontinue features
We will make reasonable efforts to notify users of significant changes or extended downtime.
9. Termination
9.1 By You
You may terminate your account at any time through your account settings or by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.
9.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for us
We will provide notice before termination unless immediate action is required to protect the Service or other users.
9.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive (e.g., liability limitations, indemnification).
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOURCEKEEP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Service interruptions
- Unauthorized access to your data
- Conduct of third parties
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless SourceKeep and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any third-party rights
13. DMCA and Copyright
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a DMCA takedown notice to dmca@sourcekeep.dev with:
- Identification of the copyrighted work
- Identification of the infringing material and its location
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement under penalty of perjury that you are authorized to act
- Your physical or electronic signature
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
If you do not agree to modified Terms, you must stop using the Service.
15. Governing Law and Disputes
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and SourceKeep regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms. We may assign them to a successor entity.
